On one cold day in Hobbs, new Mexico, a group of divers made a startling find in a dumpster. It was a baby in a trash bag.

Surveillance footage showed a car driving up to the dumpster where a teenage mom had her baby stuffed in a bag. The baby was in the backseat, and you can see her take the bag and toss it in the dumpster before driving away.

That same surveillance camera caught the dumpster divers scavenging for goods when they heard a sound. A sound what they thought was being made by a cat.

So the divers retrieved the bag and found the baby alive.

April Nutall, one of the divers, took charge of the baby and cradled the poor infant while they called for help.

“She could have took him to a hospital, took him to a church, took him somewhere. Other than throwing him away like a piece of trash,” Nutall said.

The suspect was identified as 18-year-old Alexia Avila. Avila delivered her baby in her home earlier that day.

She’s pleaded not guilty to the charges.

The child’s 16-year-old father claims he didn’t know Avila was pregnant. He’s now trying to get custody of the boy named Saul.

Avila’s mother has come out in defense of her teen daughter. She says “Everybody makes mistakes” even going so far to comment that, “People can preach all they want, they can judge all they want, but we only care about the judgment of one.”

Saul is in stable condition at a hospital in Lubbock, Texas. The New Mexico Children, Youth and Families Department (NMCYFD) has taken “lawful custody” of the abandoned baby.

Hobbs Acting Police Chief August Fons says he could not release additional details Monday due to confidentiality concerns.

Joe Imbriale is the local store owner whose surveillance cameras captured the shocking footage. Avila’s mother claims she banned the father from seeing her daughter as he was abusive.

“Even if she doesn’t want custody, she should be caring enough about her grandbaby to be saying, ‘No, he’s an abusive boyfriend, and I don’t want him to have custody.” Imbriale said.

According to investigators, there are loopholes in Avila’s narration of events. The teen’s mother, Martha, has taken heat herself.

“She’s trying to defend her daughter, why doesn’t she stop shouting her mouth off and take ownership of how she raised her daughter,” Imbriale continued. “Stop trying to protect her now. You screwed up, you raised a terrible daughter.”

Dumpster divers Michael Green, Hector Jasso and April Nuttall responded quickly upon finding the baby, calling authorities which surely saved the child’s life.

Alexis Avila has been placed on house arrest and is ordered to wear a GPS monitor while she awaits her day in court.

“If you’re struggling with a new infant, and you’re unable to take care of that baby, the best response is to find somebody that can help you at a designated safe haven,” Fons said.
